Accidents Involving Drunk or Impaired Drivers
In Ohio, drunk drivers are responsible for hundreds of deaths each year and thousands of injuries, many of which are very serious. One recent study found that drunk drivers were involved in over 14,000 traffic accidents, injuring 8,650 people. In addition, over 400 deaths were related to alcohol related crashes in a single year.
Who is Responsible?
Obviously, the operator of a motor vehicle is responsible for his/her decision to operate a motor vehicle while under the influence of alcohol. However, owners of bars, clubs, or other establishments that serve alcohol are prohibited from serving alcohol to a person who is visibly intoxicated.
A person who has been injured by a drunk driver, or whose loved one has been killed by a drunk driver, can obtain compensation from the operator of the motor vehicle, the insurance company that insured the drunk driver’s vehicle, and, in some cases, from the establishment that served the intoxicated driver. Lawsuits against an establishment that served a drunk driver are known in Ohio as Dram Shop suits.
